This comprehensive course is designed to not only teach managers and supervisors their responsibilities in preventing inappropriate behaviors, it also provides the training necessary in these areas.
The laws have recently changed in California. We expect other states to follow shortly. If you have five (5) or more employees you must train them prior to January 1, 2020 and continue to train them thereafter. There is also an additional group being protected – that is based on gender identity and preference. The laws are now also requiring much more responsibility of people in positions of power.
We discuss the most recent federal government regulations, as well as providing a brief history of the development of these work place protections. We also discuss in detail California’s requirements in preventing harassment, abusive behavior, bullying and discrimination. California is usually among the states providing the most stringent protections – and other states usually follow these examples. Although we do not cover the requirements in each and every state in a two-hour course, we believe that by following the combination of federal and California State Law, plus our recommendations to be even more prudent, you will be in compliance.
Current laws (both Federal and State) dictate the qualifications of those who are qualified trainers and the elements of the training. That information is also provided in this course.
We cover the laws and examples of discrimination, harassment (sexual and otherwise) and the rights of the victim. Finally, we offer information about handling complaints including how to treat the accused and possible remedies for the victim.
Many examples of behaviors that could be construed as either appropriate or inappropriate – depending on the point of view of those involved will be offered as well as examples of clear inappropriate behaviors. In addition to harassment and discrimination we define and discuss abusive behavior – bullying.
We not only discuss these in detail but also understanding the nuances and protections for people who gender identify differently from what is specified on their birth certificate.
In addition, there is a section on general prevention training – how to conduct it in an unbiased manner. (See also my book: Conducting Workplace Investigations: Designated Investigator and the course I’ve developed from it.)
This course was mandatory for managers and supervisors in companies having 50 or 15 or more employees. In California it has now changed to five (5) or more and other states will follow. The definition of employee has been greatly enlarged to include contractors, part-time workers, and some others. Training of supervisors and managers is required at least every two years.
Thus, this author strongly suggests that you provide training to all employees at least annually no matter how many you consider your head count. It only takes two people to have a behavior reported as either harassment, bullying, or discrimination.
Do you want to take that chance?
